The EB-2 visa category is designed for professionals holding an advanced degree (master's or higher) or its equivalent, and individuals with exceptional ability in sciences, arts, or business. A critical sub-category—the National Interest Waiver (NIW)—allows qualified applicants to bypass the labor certification process entirely if they can demonstrate their work is in the national interest of the United States. EB-2 NIW is especially popular among researchers, physicians, engineers, and entrepreneurs.

Employer files ETA Form 9089 with the Dept. of Labor; recruitment process must show no qualified US workers are available.
For NIW: draft a detailed personal statement and compile publications, citations, recommendation letters, and evidence of national-interest impact.
Submit petition with all supporting evidence; add Premium Processing (I-907) to receive adjudication in 15 business days.
Standard: 6–12 months; Premium: ~15 business days. The attorney responds to any RFE within the 87-day window.
India- and China-born applicants may need to wait for a current priority date per the monthly Visa Bulletin.
Once priority date is current, file Adjustment of Status in the US or complete consular processing at a US Embassy abroad.
